Debt Collection in the Construction Industry

How many times have you found it difficult to collect your last payment or receive payment for variations approved?
Non-payment of invoices, including as a result of disputes over variations, are extremely common within the construction industry. There are a number of available remedies for recovery of these debts.
Recovery can be sought via the statutory adjudication process under the Building and Construction Industry (Security of Payment) Act 2009 (ACT) or by way of courts or tribunals including:
• The ACT Civil and Administrative Tribunal
• The ACT Magistrates Court
• The ACT Supreme Court
