PRESS RELEASE: CLASS ACTION PUBLIC MEETINGS
14-Jun-2011 Goodman Law is representing the landholders in the local community surrounding the Port Stephens area regarding the diminution of value of their land, loss of enjoyment of their land and/or inability to develop their land, due to the potential noise exposure from the Joint Strike Fighter (JSF) flying out of the Williamtown RAAF base and increase in the existing aircraft use.
‘This legal action is about balancing public interest against personal damage. We deserve a world class defence force but not at the expense of the wellbeing of individuals.’ explained Steven Gavagna, Principal Director of Goodman Law.
The landholders surrounding the Williamtown RAAF base have made huge social and political efforts to combat these negative impacts. However, until now limited legal action has been taken. The proposed class action is against the Commonwealth of Australia.
‘A successful outcome of the class action could see a ruling made by a Court that could lead to either the JSF being restrained from flying over the Port Stephens area, or an order for compensation for those whose land is affected.’ stated Steven Gavagna.
The class action will protect:
a) Those who have land that they were developing or wanting to develop in the future;
b) Those who have residential land that may be affected by the excessive noise levels of the JSF and loss of amenity of their land; and
c) Those who have or are experiencing damage arising from increased noise levels from increases in flight frequency over existing homes.
d) Other emerging classes
Two public meetings to gather community support for the class action will be held on the 15th of June 2011, at the following locations:
When: 2pm
Where: Muree Golf Club, Walker Cres, Raymond Terrace
and
When: 6pm
Where: Raymond Terrace Bowling Club, Jacaranda Ave, Raymond Terrace
‘An enormous amount of preparatory work has already been undertaken by Goodman Law.
